Woman Held Liable in Houseguest’s Dog Attack

Posted on Thursday, December 31st, 2009 at 1:35 am

The Wisconsin Supreme Court unanimously ruled that a woman who allowed a man and his dogs to stay in her home is liable for injuries caused during an attack on another individual. The Justices ruled that by allowing the dogs to stay in her home, the woman's actions could be determined as "harboring" the animals and by doing so, the woman bears responsibility for their actions.

Sources say the woman's defense relied on showing that the dogs were under the care of their immediate owner and arguments were made that the woman had no responsibility to control her houseguest's dogs. The court disagreed with the arguments and ruled that her actions constituted liability for the injuries to the individual.

Can you file a personal injury claim if your neighbor’s pet attacks?

Posted on Monday, December 14th, 2009 at 6:55 am

While are often safe and friendly, some pets can become dangerous. When these pets lose control, they may attack their owners or other individuals.

While an owner cannot file a personal injury lawsuit against his or her pet, other individuals may be able to file a personal injury lawsuit against the pet's owner. The ability to do so, however, is contingent upon whether the owner took the necessary measures to keep his or her neighbor's away from foreseeable harm.

For instance, if an owner lets his pet free to roam the neighborhood and the pet attacks an individual, the individual will likely be able to file a personal injury lawsuit. Howeer, if the individual goes into the neighbor's yard and is attacked, then the individual may not be able to sue the owner for damages.
