What is a Tort?

In the legal world, a tort is a non-criminal action that harms someone and which is pursued in a civil court of law. A tort is similar in nature to a crime; the only difference is that a crime is considered a wrongdoing against society and is punished typically by a fine paid to the state, a prison sentence or community service, and a tort is considered a wrongdoing against an individual and is punished by a damages awarded to the victim.

If you have been harmed by the negligent or reckless actions of another party, you may be able to pursue financial compensation. In order for a defendant to be found liable for committing a tortious act, the plaintiff must prove the following in the course of a civil case:

  • Duty ‘ The defendant owed the victim a civil duty.
  • Breach of Duty ‘ The defendant failed to uphold his, her, or its civil duty.
  • Causation ‘ The accident or circumstance which produced harm was caused by the defendant’s breach of duty.
  • Injury ‘ The victim sustained physical, emotional, or financial injury as a consequence of this accident or circumstance.
